RULES & REGULATIONS: Torrid at Hawaiian Tropic Zone Red White and Boobs Official Contest Rules Contest Rules Before participating in the Contest, read and understand the complete Contest Rules. By participating in the Contest, you agree to abide fully and unconditionally to, as well as accept, these Rules. Rules are subject to change or modification without notice to participants. OFFICIAL RULES NO PURCHASE IS REQUIRED TO ENTER OR WIN. 1. SPONSOR: The Contest is sponsored by Torrid at Hawaiian Tropic Zone. 2. CONTEST TERMS: From June 5, 2008 through July 4, 2008, Sponsor will accept entries for a pageant ("The Pageant") allowing eligible individuals to enter to win the prize set forth below. All entries and associated data including photos become the property of Sponsor and will not be returned. Deadline to enter is 8:00 p.m. (PST), July 4, 2008. Sponsor reserves the right to modify scheduling of the contest without prior notice. Sponsor reserves the right to terminate or suspend the contest without notice, at any time and for any reason. The Contest is subject to all federal, state, and local laws and regulations and is void where prohibited by law. Winner of Prize will be chosen at TORRID Hawaiian Tropic Zone at Planet Hollywood Hotel and Casino, Las Vegas, during the Pageant held the evening of July 4, 2008 and extending into the morning of July 5, 2008. 3. ELIGIBILITY: In order to be eligible for the Pageant, entrants must be: 1) a U.s. citizen or legal resident of the United States at all times during the contest; (2) 21 years old or older at time of entry; (3) not an employee, agent, affiliate, officer or director of sponsor or of any advertiser, promotion agency, fulfillment agency or agent of sponsor; (4) not a relative of an employee, agent, affiliate, officer or director of sponsor or of any advertiser, promotion agency, fulfillment agency or agent of sponsor; (5) female and (6) present. False or deceptive entries or acts will render the entrant ineligible. Ineligible entrants may be disqualified at any time at the sole discretion of Sponsor. 4. AGREEMENT TO OFFICIAL RULES: Participation in the Pageant constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor, which are final and binding. Any winner who does not comply with the Official Rules will be disqualified. 5. ENTRY: To enter, visit http://www.HawaiianTropicZone.com. follow the links to the Pageant page, and submit your information as outlined in the instructions provided. Registration is free and requires a valid email address. One (1) entry per person. Registration may occur in person on July 4, 2008 at Torrid Hawaiian Tropic Zone or online between June 5th, 2008 and July 4th , 2008. Contestants registering online must complete the Contest entry form with all required information at www. HawaiianTropicZone.com or DrPancholi.com No other forms of entry are allowed. 6. REQUIREMENTS OF THE POTENTIAL WINNERS: Except where prohibited, the potential winners will be required to complete and return an affidavit of eligibility and liability/publicity release (the "Affidavit/Release") within seven (7) days of being notified. If a potential winner fails to sign and return the Affidavit/Release within the required time period, Sponsor will select an alternate potential winner in her place. If a potential winner is found to be less than 21 years of age she will be disqualified as ineligible according to the terms set forth above. Winner will be determined by three judge selection on July 4, 2008. The winner will not receive the Prize unless she submits to Sponsor an executed W-9. 7. PRIZES: For each person who enters the contest online by submitting all requested information, as outlined on the web site, a Gift Certificate for $50 will be awarded by Cosmetic Surgery of Las Vegas, good towards select Cosmetic Surgery products and procedures as offered by Cosmetic Surgery of Las Vegas. Only one Gift Certificate will be awarded per person. Gift Certificates cannot be combined with other Gift Certificates, are non redeemable for cash, and non transferable. All Gift Certificates will be issued with in 60 days of end of Pageant. Duplicate entries or attempts at fraudulent entries will result in disqualification. One (1) Prize of $1800 ("Prize") will be awarded to winner. Winner may, at her own discretion and without influence from sponsor, elect use Prize towards obtaining a saline breast augmentation at Cosmetic Surgery of Las Vegas at no additional charge. A "Saline Breast Augmentation" shall consist of cosmetic surgery to enhance the shape of the breast by saline implant placement and include the cost of anesthesia, anesthesiologist, surgery center, consultation, and post operative visits as customary at Cosmetic Surgery of Las Vegas. Prize is nontransferable and non-refundable and must be accepted as awarded. Winner will be solely responsible for payment of any taxes on the Prize, if applicable. If Winner elects to use Prize towards saline breast augmentation at Cosmetic Surgery of Las Vegas, surgery must be scheduled to occur within 60 days of award. The winner must be medically cleared (pre-operative fitness/readiness as determined by Cosmetic Surgery of Las Vegas in their sale discretion) to undergo the procedure. Additional costs may apply to Winner electing to undergo saline breast augmentation including, but not limited to, transportation, other surgical procedures, prescription medication, laboratory evaluation, mammogram, hospital admissions and treatment, emergency ambulatory services, pathology evaluations and follow-up, if necessary. Winners are responsible for all uncovered costs and taxes associated with receipt and use of prize. If winner is found not to be medically or surgically sUitable, the Prize of $1800 will stand and be final. 8. GENERAL CONDITIONS: Sponsor reserve the right to cancel, suspend, and/or modify the Pageant if any fraud, virus, or other technical problem corrupts the administration, security, or proper play of the Pageant, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Pageant or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Pageant may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsors' failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. 9. PUBLICITY: Except where prohibited, participation in the Pageant constitutes Winner's consent to Sponsor's and Cosmetic Surgery of Las Vegas's use of Winner's name, likeness, voice, opinions, pictures including before and after, biographical information and state of residence for promotional purposes in any media, worldwide, without further payment or consideration, forever. 10. PRIVACY: All information submitted by entrants as part of this Pageant will be treated in accordance with Sponsors' Privacy Policies. 11. RELEASE: By receipt of the Prize, winner agrees to release and hold harmless Sponsor and Cosmetic Surgery of Las Vegas, each of their respective related companies and each such company's officers, directors, employees, and agents (the" Released Parties") from and against any claim or cause of action arising out of participation in the Pageant or receipt or use of any prize. 12. LIMITATIONS OF LIABILITY: The Released Parties (Sponsor and Cosmetic Surgery of Las Vegas) are not responsible for: (a) any inaccurate information, whether caused by entrants or printing errors; (b) unauthorized human intervention in any part of the Pageant; (c) technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware or software; (d) technical or human error which may occur in the administration of the Pageant or the processing of entries; (e) lost, delayed, misdirected, or undeliverable mail; or (f) any injury or damage to persons or property including, but not limited to, death, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Pageant or receipt or use of any Prize. 13. DISPUTES: Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Pageant or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of New York; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Pageant, but in no event attorneys' fees; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor or Cosmetic Surgery of Las Vegas in connection with the Pageant, shall be governed by, and construed in accordance with, the laws of State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of New York.
